SmartB Platform Terms & Conditions

Effective Date: March 27, 2026

These Terms & Conditions ("Terms") govern all access to and use of SmartB products and services including SmartPlay, SmartOdds, AI-driven analytics, SmartCoins, and all associated services ("Platform").

These Terms are intentionally broad and protective of SmartB and operate separately from contest rules.

PART A – FULL WEBSITE TERMS

1. Binding Agreement & Eligibility

By accessing or using the Platform, you:

Enter a legally binding agreement with SmartB
Confirm you are at least 18 years old
Confirm you are not prohibited under any applicable laws
Confirm you are not acting on behalf of another person or entity without authority

SmartB may refuse service to any person at its sole and absolute discretion.

2. Regulatory Position & Nature of Services

SmartB:

Does not operate as a licensed wagering operator unless explicitly stated
Provides services for entertainment and informational purposes only
Does not provide financial, investment, or betting advice

Users acknowledge all participation is at their own risk.

3. Australian Consumer Law (ACL) Compliance

Nothing in these Terms excludes non-excludable rights under the Competition and Consumer Act 2010 (Cth).

Where liability cannot be excluded, SmartB limits its liability to the maximum extent permitted by law, including:

Re-supply of services
Refund of amounts paid

4. Absolute Disclaimer - Data, AI & Odds

SmartB provides AI-generated insights, odds comparisons, statistical data, projections, recommendations, and other automated outputs strictly for entertainment and informational purposes only.

SmartB makes no representations or warranties whatsoever regarding:

Accuracy
Reliability
Completeness
Timeliness
Suitability for any purpose
Fitness for decision-making

Users acknowledge and agree that:

AI outputs may be incorrect, incomplete, delayed, biased, inaccurate, or misleading
Data feeds may fail, be interrupted, or be delayed
AI-generated content may contain errors, omissions, or flawed assumptions
No user should rely on any AI output, odds, data, projections, or recommendations for financial, betting, commercial, or personal decision-making
Any use of or reliance on Platform data is entirely at the user's own risk

To the maximum extent permitted by law:

SmartB accepts no responsibility or liability whatsoever for any loss, damage, cost, claim, liability, or outcome arising directly or indirectly from the use of, or reliance on, Platform data, AI outputs, odds, analytics, or related information
All AI outputs, data, and automated insights are provided on an "as is" and "as available" basis
SmartB does not guarantee that any AI result, insight, or data point is accurate, complete, current, suitable, or free from defect

This clause applies regardless of negligence, system error, algorithmic error, third-party data failure, outage, interruption, or any other cause.

5. Account Control & User Responsibility

Users are fully responsible for:

All account activity
Security credentials
Participation decisions

SmartB is not liable for:

Unauthorised access
User errors
Failure to participate in contests

6. Enhanced KYC, AML & Counter-Terrorism Financing (CTF)

SmartB implements strict compliance measures under:

Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)

SmartB may at any time, and from time to time, including multiple times throughout the life of an account:

Require identity verification
Re-request identity verification
Request updated identification documents
Conduct enhanced due diligence
Monitor transactions
Conduct ongoing account and behavioural reviews
Require source of funds and source of wealth information
Require any additional documentation or information SmartB considers necessary for compliance, risk management, fraud prevention, or operational integrity

SmartB may:

Freeze accounts indefinitely
Block transactions
Delay or refuse withdrawals
Suspend or close accounts
Report users to AUSTRAC, law enforcement agencies, regulators, courts, government bodies, or other competent authorities
Disclose, provide, or share user data, account information, transaction records, identity documents, and related information where required by law, regulation, lawful request, or where SmartB reasonably considers such disclosure necessary for investigation, compliance, fraud prevention, or enforcement purposes

Users must not:

Use the Platform for money laundering
Use third-party funds
Attempt to disguise transaction origins
Provide false, misleading, incomplete, or outdated information
Attempt to avoid, circumvent, or frustrate KYC, AML, fraud, or verification processes

Failure to comply with any KYC, AML, source of funds, or verification requirement may result in:

Account suspension
Account restriction
Permanent account closure
Withholding or forfeiture of balances
Reversal of winnings where permitted by law or reasonably required for compliance or fraud prevention

7. Source of Funds & Financial Integrity

Users warrant that:

All funds are legally obtained
Funds are not linked to criminal activity

SmartB may request proof of source of funds.

Failure to comply may result in:

Permanent account closure
Forfeiture of all balances

8. SmartCoins - Legal Position

SmartCoins:

Are a revocable licence, not property
Have no cash value unless explicitly allowed
Are subject to modification or removal at any time

SmartB may:

Adjust balances without notice
Expire or void coins

9. Bonus Abuse, Arbitrage & Advantage Play

Prohibited behaviour includes:

Multi-accounting
Coordinated play
Exploiting pricing or system inefficiencies

SmartB may:

Void all activity
Reverse winnings (including historical)
Confiscate balances

10. Cheating, Collusion & Exploitation

Users must not:

Use bots, scripts, or automation
Share lineups or coordinate outcomes
Exploit bugs or loopholes

SmartB may take action including:

Retroactive disqualification
Lifetime bans
Withholding all funds

11. System Errors - Absolute Operator Rights

In the event of any error (technical, human, or system):

SmartB reserves the unrestricted right to:

Void any transaction or contest
Reverse winnings at any time (including after withdrawal)
Recalculate outcomes

Users waive any claim arising from such corrections.

12. Risk Management & Settlement Controls

SmartB may apply internal risk controls including:

Manual reviews
Delayed settlements (no time limit)
Withholding of payouts

These controls are final and non-negotiable.

13. Withdrawals - Full Control Clause

SmartB may:

Delay withdrawals indefinitely
Set minimum and maximum withdrawal limits
Require additional verification at any time

Withdrawals may be refused where:

Fraud is suspected
KYC is incomplete
Terms are breached

SmartB is not liable for delays.

14. Forfeiture of Funds

SmartB may confiscate funds where:

Fraud is suspected
Terms are breached
Regulatory obligations require action

No compensation is payable.

15. Fraud Detection & Enforcement

SmartB uses monitoring systems to detect:

Irregular play patterns
Collusion
Financial anomalies

SmartB decisions are final and not subject to dispute.

16. Suspension, Closure & Blacklisting

SmartB may:

Suspend accounts without notice
Permanently ban users
Share information with other platforms or authorities

17. Third-Party Services & Data

SmartB relies on third-party providers.

SmartB is not liable for:

Provider failures
Data inaccuracies
Service interruptions

18. Limitation of Liability (Maximum Scope)

To the fullest extent permitted by law:

SmartB excludes all liability for:

Indirect or consequential loss
Loss of profits
Loss of opportunity

Total liability is capped at:

The lesser of $100 AUD or total user deposits in the last 3 months

19. Indemnity (Broad Form)

Users indemnify SmartB against all claims arising from:

Use of the Platform
Breach of Terms
Violation of laws

20. No Warranty

The Platform is provided "as is" and "as available" with no warranties.

21. Force Majeure

SmartB is not liable for events outside its control including:

System outages
Data failures
Regulatory actions

22. Amendments

SmartB may update Terms at any time without notice. Continued use = acceptance.

23. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Users submit to exclusive jurisdiction of NSW courts.

24. Chargebacks & Payment Reversals

Users must not initiate chargebacks or payment disputes without first contacting SmartB.

Where a chargeback occurs, SmartB may:

Immediately suspend the account
Recover the disputed amount
Offset any account balance
Permanently ban the user

Users remain liable for all amounts owed.

25. Dormant Accounts & Balance Expiry

Accounts inactive for 12 months may be classified as dormant.

SmartB may:

Suspend dormant accounts
Expire SmartCoins or balances
Apply administrative fees where permitted by law

Users are responsible for maintaining account activity.

26. Geo-Restrictions, VPN & Location Controls

Users must not:

Access the Platform from restricted jurisdictions
Use VPNs, proxies, or masking tools to bypass restrictions

SmartB may:

Block access
Suspend accounts
Void winnings

27. Tax Responsibility

Users are solely responsible for:

Declaring winnings
Paying applicable taxes

SmartB provides no tax advice and accepts no liability for tax obligations.

28. Dispute Resolution (Operator-Favouring)

All disputes must be submitted to SmartB support.

Users agree that:

SmartB decisions are final and binding
No class actions may be brought
Disputes must be resolved individually
SmartB may elect the method of dispute resolution

29. Game Mechanics & Platform Changes

SmartB may at any time:

Modify contest formats
Change scoring systems
Alter prize structures
Suspend or remove features

No compensation is payable for such changes.

30. Affiliate Abuse & Syndicate Detection

Users must not:

Engage in coordinated group play
Exploit affiliate programs
Use syndicates to manipulate outcomes

SmartB may:

Void all related activity
Confiscate funds
Terminate all linked accounts

31. Extended Operator Rights Clause

SmartB retains absolute discretion over all aspects of the Platform, including:

Account management
Fund handling
Contest outcomes

All decisions made by SmartB are final, binding, and not subject to appeal.

Product-specific subscription terms supplementing the SmartB Platform Terms & Conditions

These Product Subscription Terms & Conditions (Product Terms) apply when you access, purchase or use SmartBetsAI, Hong Kong Racing Tips, or any free or paid content made available as part of those products (each a Product). They supplement the SmartB Platform Terms & Conditions and the SmartB Privacy Policy. By subscribing to or using a Product, you agree to these Product Terms as well as the Platform Terms.

1. Application, Contracting Party and Order of Terms

"SmartB", "we", "us" and "our" mean the SmartB entity identified as the supplier of the relevant Product at checkout and in the SmartB Platform Terms & Conditions.
If there is an inconsistency, the following order applies to the extent of the inconsistency: (a) any specific promotion or offer terms; (b) the applicable Product Schedule below; (c) these Product Terms; and (d) the SmartB Platform Terms & Conditions. Nothing in these documents excludes rights that cannot lawfully be excluded.
The SmartB Privacy Policy applies separately to the collection, use and disclosure of personal information.

2. Eligibility and Your SmartB Account

You must be at least 18 years old and legally permitted to access the Product in the jurisdiction where you are located.
A SmartB account may be required. You are responsible for keeping your login credentials secure and for all activity conducted through your account, subject to applicable law.
Subscriptions are personal to the account holder. You must not share paid access, passwords, tip emails or subscriber-only content with another person, or use one subscription to provide access to a group, syndicate, business or resale service.
We may apply reasonable location, security, fraud-prevention and account controls in accordance with the Platform Terms and applicable law.

3. Nature of the Products

The Products provide racing information, analysis, selections, model outputs, editorial commentary, results information, odds information and related tools, depending on the Product and the features available at the time.
SmartB is not a bookmaker or wagering operator for the purposes of these Products and does not accept bets through SmartBetsAI or Hong Kong Racing Tips. A Product may link to third-party wagering providers or display third-party prices.
The Products are provided for information and entertainment purposes only. They are not financial, investment, legal or betting advice and are not a substitute for your own judgement.
No tip, selection, confidence score, analysis, historical result, odds display or other information is a promise or guarantee that a runner will win, place, perform as expected or produce a profit.

4. Subscription Price, Billing and Automatic Renewal

The price, billing period, currency and any introductory offer that apply to your subscription are shown at checkout or on the relevant offer screen before you subscribe.
Unless stated otherwise, a paid subscription automatically renews for the same billing period until you cancel it. By subscribing, you authorise SmartB and its payment processor to charge the payment method you provide for each renewal.
Prices are in Australian dollars unless stated otherwise and include GST where required by law.
If we change the recurring price of an existing subscription, we will provide any notice required by law before the new price applies to a future renewal. You may cancel before the affected renewal.
A failed, expired or declined payment may result in payment retries, a payment-exception status and, after reasonable notice where practicable, restriction or suspension of paid access. Restoring a valid payment method may restore access according to the subscription state shown in your account.

5. Trials, Free Content and Promotions

If a free trial, discounted period or promotion is offered, the duration, eligibility conditions, renewal price and any additional conditions will be stated in the offer. Separate promotion terms may apply.
Free tips, previews, Tip of the Day, Daily Best Bets and other sample content may be changed, limited, paused or withdrawn. Free content does not create an entitlement to the full paid Product.
We may limit introductory offers to eligible users and may take reasonable steps to prevent repeated or abusive use of free trials or promotional pricing.

6. Cancellation, Access End and Reactivation

You may cancel a recurring subscription using the subscription-management tools made available in your SmartB account or by contacting SmartB support.
Unless we state otherwise or applicable law requires a different outcome, cancellation stops future renewal and paid access continues until the end of the period already paid for. Your account may show a cancellation-pending state and the date on which paid access will end.
After paid access ends, subscriber-only tips, paid emails and premium controls may be removed or disabled. Free communications may continue only where you remain eligible and have the relevant communication preference enabled.
Subscription fees are not refundable merely because you change your mind or do not use the Product. This does not limit any refund, remedy or other right you have under the Australian Consumer Law or other applicable law.

7. Delivery, Timing and Availability

Product content may be delivered through the SmartB website, app, dashboard, email, notifications or other channels described in the Product or offer.
We aim to make racing content available in a useful timeframe, but we do not guarantee a particular publication or email-delivery time. Race data, model processing, editorial review, third-party feeds, outages, mail providers and late changes can affect timing.
Coverage can vary by day, racing code, meeting, country, data availability and Product. We do not guarantee that a tip or analysis will be available for every race, meeting or racing day.
If a race is postponed, abandoned, rescheduled, corrected or affected by a scratching or other material change, we may update, withdraw or replace associated information. You should verify current race status before making any wagering decision.

8. Tips, Selections and Analysis

A tip or selection reflects the information and methodology available at the time it is generated or published. New information can cause a selection, confidence level, analysis or ranking to change before a race.
Where content is identified as AI-generated or model-generated, it may contain errors, omissions, flawed assumptions or outputs affected by incomplete, delayed or inaccurate input data.
Where content is identified as editorial or attributed to a tipster or analyst, it reflects that contributor's analysis at the time of publication and remains opinion-based information rather than a guarantee of outcome.
We may correct clear errors in tips, race details, times, prices, results or explanatory text. If a correction affects historical reporting, the related records or metrics may also be corrected.

9. Odds, Bookmaker Information and Third-Party Links

Odds and market information are supplied by or derived from third parties. Prices may change quickly, be suspended, be unavailable or differ from the price available when you visit a wagering provider.
Where we use labels such as "Best Odds" or "best available price", the label refers only to the provider universe, market type and freshness rules displayed or otherwise defined for that feature. It does not mean that the price is the best price available everywhere or that it will remain available.
A timestamp or "last checked" time indicates when the relevant price data was observed or refreshed. It is not a guarantee that the price is still available.
A link to a bookmaker, betting exchange, tote or other third party does not mean that SmartB accepts the bet, guarantees the price, guarantees your eligibility or controls the third party's service. Any transaction you enter into is directly between you and that third party and is subject to its terms.
Promotional or advertising content from wagering providers is subject to applicable law and SmartB account preferences where those preferences apply. Turning gambling advertising off does not necessarily remove non-promotional racing information or functional odds-comparison data.

10. Results and Performance Information

Results and performance information are historical. Past strike rates, wins, places, returns, average odds, profit/loss or other historical metrics do not predict or guarantee future performance.
Where performance metrics are published, they should be read together with the stated period, tip category, result definition, staking or odds method and any other methodology displayed with the metric.
We may wait for an official or sufficiently confirmed result before settling a tip. Results and related metrics may be updated following protests, dead heats, disqualifications, amended official results, scratchings, abandoned races or data corrections.
Performance reporting may exclude or treat void, scratched, abandoned or otherwise unsettled tips according to the methodology applicable to that report. Any methodology does not convert historical results into a guarantee of future returns.

11. Intellectual Property and Permitted Use

The Products and their content, including selections, analysis, model outputs, databases, results presentations, design, branding and compilations, are owned by or licensed to SmartB and are protected by intellectual-property laws.
Your subscription gives you a limited, personal, non-exclusive, non-transferable right to access the Product for your own private use during your entitlement period.
Unless SmartB gives written permission, you must not republish, resell, redistribute, scrape, systematically copy, commercially exploit, reverse engineer, circumvent access controls, create a competing data feed from, or use bots/scripts to extract subscriber-only Product content. You may share ordinary links to publicly available SmartB pages, but you must not share subscriber-only access credentials or reproduce paid tips or analysis for the purpose of avoiding or facilitating avoidance of a subscription.

12. Communications and Preferences

We may send service and transactional communications that are reasonably necessary to operate your subscription, including purchase confirmations, billing notices, payment-failure notices, cancellation confirmations, access-end notices and material service notices.
Marketing, free-tip and performance communications are subject to the communication preferences available in your SmartB account and applicable law. You can change those preferences or unsubscribe from relevant marketing messages.
Changing a marketing or gambling-advertising preference does not necessarily stop essential transactional messages relating to an active subscription or account.

13. Responsible Gambling

Gambling involves risk and you can lose money. You should never treat a tip, confidence score, odds display or historical result as a reason to wager more than you can afford to lose.
If gambling is causing harm or concern, seek help. In Australia, free and confidential support is available through Gambling Help Online and on 1800 858 858.
SmartB may display responsible-gambling information, tools and support links in connection with the Products.

14. Suspension and Termination

We may restrict, suspend or terminate Product access where reasonably necessary because of a material breach of these Product Terms or the Platform Terms, unlawful activity, payment failure, fraud or security concerns, misuse of subscriber content, a legal or regulatory requirement, or a serious technical or service-integrity issue.
Where appropriate and lawful, we may give you an opportunity to remedy a breach. Serious or deliberate misuse may result in immediate action.
If your broader SmartB account is suspended or closed under the Platform Terms, access to a Product may also be affected.

15. Changes to Products

Racing schedules, providers, data feeds, model versions, tip formats, confidence labels, bookmaker availability, comparison features, delivery channels and other Product features may change over time.
We may make reasonable changes to improve, maintain, secure or comply with legal requirements for a Product. Where a change materially affects an ongoing paid subscription, we will provide any notice or remedy required by law.
We may discontinue a Product. If we do so during a paid period, any remedy will be provided in accordance with applicable law and the circumstances of the discontinuation.

16. Consumer Guarantees, Disclaimers and Liability

Your consumer rights are protected — Nothing in these Terms limits rights or guarantees that cannot legally be excluded, including those under the Australian Consumer Law.
Content is not guaranteed — Tips, models, race data, odds, results and other content may not always be accurate, complete, current, uninterrupted or error-free.
No guaranteed outcomes — Tips and analysis are for informational purposes only. SmartB is not responsible for losses resulting from wagering decisions you make or reliance on tips as guaranteed outcomes.
Third-party information and services — SmartB is not responsible for third-party provider conduct, data inaccuracies or price changes after odds are displayed. Other liability limitations in the SmartB Platform Terms also apply where permitted by law.

17. Changes to These Product Terms

We may update these Product Terms from time to time. If a change materially affects an existing paid subscription, we will provide any notice required by law and will apply the change in a manner consistent with applicable consumer protections.
The version and effective date published with these Product Terms identifies the terms currently in force.

18. Governing Law and Disputes

These Product Terms are governed by the laws of New South Wales, Australia, consistently with the SmartB Platform Terms, subject to any non-excludable rights you have under applicable law.
If you have a complaint about a Product or subscription, contact SmartB support first so we can investigate and attempt to resolve it.

Schedule 1 - SmartBetsAI

This Schedule applies specifically to SmartBetsAI. If it conflicts with the general Product Terms, this Schedule prevails for SmartBetsAI to the extent of the conflict.

A. Product Description

SmartBetsAI is a recurring racing-information and analysis subscription built around model-generated racing selections, confidence information, race analysis, results tracking and odds-comparison utilities.
SmartBetsAI may cover supported thoroughbred, greyhound and harness racing across the meetings and jurisdictions displayed in the Product. Availability depends on fixtures, data feeds, model eligibility and service support.
Paid access may include the full available daily racing card, a Today's Tips/dashboard experience, highest-confidence views, race/selection analysis, results, bookmaker preferences, price comparison, BlackBook access and subscription/email settings, to the extent those features are available in the released Product.

B. Price and Billing

The current SmartBetsAI project baseline is $8.99 per month, billed monthly, with cancellation available at any time. If an approved price or offer displayed at checkout is different, the checkout price and offer terms apply to that purchase. The subscription renews monthly until cancelled, subject to the general Product Terms.

C. Free and Paid Access

SmartB may make selected SmartBetsAI content available free, including Tip of the Day and Daily Best Bets. Free content is a limited sample and does not include the full paid entitlement.
The number of free tips, the races represented and the public/registered/subscriber access level of supporting features may change as the Product evolves.

D. AI Selections and Confidence

SmartBetsAI selections, rankings, explanations and confidence outputs are generated from approved model and data inputs. Model outputs can be wrong and are not probabilities of success unless expressly stated as calibrated probabilities.
A label such as "Highest Confidence", "Highest-Ranked", "High" or a confidence score describes the model's relative signal under the applicable methodology. It does not mean "safe", "sure", "guaranteed", "can't lose" or any equivalent outcome certainty.
Eligibility for rankings may depend on supported meetings/codes, data sufficiency, model freshness and scratching status. A race with unavailable or insufficient model output may have no SmartBetsAI selection.

E. Bookmaker Preferences and Odds Comparison

Where available, SmartBetsAI may allow you to save up to five preferred bookmakers for personalised price comparison. Provider availability and the treatment of Betfair, totes or additional market feeds may differ by feature and will be shown in the Product.
Win and Place markets may be displayed where available. Other market types may also be displayed if supported.
Prices are time-sensitive. You must check the displayed freshness information and verify the price with the wagering provider before betting.

F. Results and Performance

SmartBetsAI may track published selections and show results by period, racing code, country, tip type or other filters. A result can remain pending until the required official result state is received.
Performance summaries must be understood within their stated scope and methodology. They are historical evidence only and do not guarantee future performance or profitability.
SmartB may correct historical result records or recalculate metrics if an official result is amended, a data error is found or a documented settlement rule requires correction.

G. Subscription State After Cancellation

If you cancel before the end of a paid month, SmartBetsAI paid access is intended to continue until the displayed access-end date unless access is suspended earlier for a reason permitted under the general Product Terms or applicable law.
After paid access ends, free Tip of the Day and Daily Best Bets communications may remain available if you are eligible and have chosen to receive them. Paid daily tips and premium controls may be removed or disabled.

Schedule 2 - Hong Kong Racing Tips

This Schedule applies specifically to Hong Kong Racing Tips. If it conflicts with the general Product Terms, this Schedule prevails for Hong Kong Racing Tips to the extent of the conflict.

A. Product Description

Hong Kong Racing Tips is a racing-information and tipping service focused on Hong Kong thoroughbred racing.
Coverage may include supported meetings at Sha Tin, Happy Valley and other Hong Kong racing events or meeting formats that SmartB makes available. Coverage of every meeting or every race is not guaranteed.
Content may include race-by-race selections, best bets, analysis, commentary, confidence or ranking information, results and related racing information, depending on the offer and service format available at the time.

B. Editorial and Model-Assisted Content

Hong Kong Racing Tips content may be editorial, data-assisted, model-assisted or a combination. The Product will identify AI/model-generated content where that distinction is material.
Where a tip or analysis is attributed to a named contributor, it is that contributor's racing opinion at the time of publication and may be updated for scratchings, track conditions, draw changes, late information or other relevant factors.
Hong Kong Racing Tips is not SmartBetsAI merely because both services appear within the SmartB ecosystem. SmartBetsAI-specific AI confidence terms apply to Hong Kong Racing Tips only where the Hong Kong content is expressly identified as using SmartBetsAI or another AI/model output.

C. Subscription and Delivery

The subscription price, billing period and any introductory offer for Hong Kong Racing Tips are the amounts and terms displayed at checkout or on the offer screen when you subscribe.
Tips may be delivered by email, web/app access, dashboard, notification or another channel stated in the offer. Delivery timing may vary with the Hong Kong racing schedule and the availability of race, track and market information.
If a meeting is postponed, abandoned, rescheduled or materially changed, SmartB may delay, update, replace or withdraw the affected content. A change to a scheduled meeting does not create a guaranteed replacement tip for every affected race.

D. Odds and Race Information

If odds are shown, they are indicative third-party market information and can change at any time. You must verify the current market and your eligibility directly with the relevant wagering provider.
Race times may be displayed in Hong Kong time, Australian time or another timezone as labelled. You are responsible for checking the applicable race time and any late scheduling change.

E. Results and Historical Performance

Product-specific subscription terms supplementing the SmartB Platform Terms & Conditions.

1. Eligibility & Acceptance

By using SmartPlay, you confirm you are at least 18 years old and legally capable of entering this agreement.
You must register and maintain accurate account information. We may accept or reject registration at our discretion and suspend or terminate accounts due to false information or breach of these Terms.

2. Definitions

"SmartCoins": the site's virtual currency, convertible to real currency (subject to withdrawal restrictions).
"Bonus Coins": promotional credits awarded by SmartPlay; only usable to enter games. Bonus Coins are not withdrawable and must be converted into SmartCoins via gameplay before withdrawal.
"Entry": participation in a game or contest using SmartCoins or Bonus Coins.
"Prize Pool": total rewards for a contest.
"Rake": portion of entry fees retained by SmartPlay.

3. Subscription & Entry Fees

Where applicable, entry fees (in SmartCoins or real currency) are payable in advance.
SmartPlay may change fees; notice will be given, and changes apply from the next billing or entry cycle.

4. Game Entry & Payouts

To enter any game, an account is required; entries must follow contest-specific rules (e.g., lineup, entry limits).
Once an entry is confirmed, it's binding. SmartPlay determines and pays out prizes according to published rules.

5. Bonus Coins

Bonus Coins are granted at SmartPlay's sole discretion (e.g., promotions or loyalty rewards).
They cannot be withdrawn directly. You must use Bonus Coins to participate in games to convert them into SmartCoins, which are withdrawable.
Bonus Coins expire 30 days from issuance if unused.

6. Fraud & Anti-Money Laundering (AML)

SmartPlay employs measures to detect and prevent fraud, money laundering, and suspicious activity.
We may require identity verification, documentation, or deny transactions where compliance is not met.

7. Withdrawals

Withdrawals of SmartCoins to real currency will be processed; funds will be made available within 5 business days of a valid request and completion of any required verifications.
Withdrawal limits and methods are subject to our withdrawal policies and may require ID checks.

8. Account Security

Keep your login credentials confidential. You are liable for all actions taken under your account.
Sharing accounts may result in immediate termination.

9. Fees & Taxes

To the maximum extent permitted by law, SmartPlay disclaims all warranties, implied or express, including fitness for a particular purpose.
We are not liable for indirect, incidental, consequential, special, or punitive damages.
Our total liability is capped at the total real-currency amount you have paid or deposited in the prior 12 months.

All content, software, and design are owned by SmartPlay or licensed to us. You agree not to reproduce, distribute, or modify our IP without express written permission.
