SmartB Platform Terms & Conditions

Effective Date: March 27, 2026

These Terms & Conditions ("Terms") govern all access to and use of SmartB products and services including SmartPlay, SmartOdds, AI-driven analytics, SmartCoins, and all associated services ("Platform").

These Terms are intentionally broad and protective of SmartB and operate separately from contest rules.

PART A – FULL WEBSITE TERMS

1. Binding Agreement & Eligibility

By accessing or using the Platform, you:

  • Enter a legally binding agreement with SmartB
  • Confirm you are at least 18 years old
  • Confirm you are not prohibited under any applicable laws
  • Confirm you are not acting on behalf of another person or entity without authority

SmartB may refuse service to any person at its sole and absolute discretion.

2. Regulatory Position & Nature of Services

SmartB:

  • Does not operate as a licensed wagering operator unless explicitly stated
  • Provides services for entertainment and informational purposes only
  • Does not provide financial, investment, or betting advice

Users acknowledge all participation is at their own risk.

3. Australian Consumer Law (ACL) Compliance

Nothing in these Terms excludes non-excludable rights under the Competition and Consumer Act 2010 (Cth).

Where liability cannot be excluded, SmartB limits its liability to the maximum extent permitted by law, including:

  • Re-supply of services
  • Refund of amounts paid

4. Absolute Disclaimer – Data, AI & Odds

SmartB provides AI-generated insights, odds comparisons, statistical data, projections, recommendations, and other automated outputs strictly for entertainment and informational purposes only.

SmartB makes no representations or warranties whatsoever regarding:

  • Accuracy
  • Reliability
  • Completeness
  • Timeliness
  • Suitability for any purpose
  • Fitness for decision-making

Users acknowledge and agree that:

  • AI outputs may be incorrect, incomplete, delayed, biased, inaccurate, or misleading
  • Data feeds may fail, be interrupted, or be delayed
  • AI-generated content may contain errors, omissions, or flawed assumptions
  • No user should rely on any AI output, odds, data, projections, or recommendations for financial, betting, commercial, or personal decision-making
  • Any use of or reliance on Platform data is entirely at the user's own risk

To the maximum extent permitted by law:

  • SmartB accepts no responsibility or liability whatsoever for any loss, damage, cost, claim, liability, or outcome arising directly or indirectly from the use of, or reliance on, Platform data, AI outputs, odds, analytics, or related information
  • All AI outputs, data, and automated insights are provided on an "as is" and "as available" basis
  • SmartB does not guarantee that any AI result, insight, or data point is accurate, complete, current, suitable, or free from defect

This clause applies regardless of negligence, system error, algorithmic error, third-party data failure, outage, interruption, or any other cause.

5. Account Control & User Responsibility

Users are fully responsible for:

  • All account activity
  • Security credentials
  • Participation decisions

SmartB is not liable for:

  • Unauthorised access
  • User errors
  • Failure to participate in contests

6. Enhanced KYC, AML & Counter-Terrorism Financing (CTF)

SmartB implements strict compliance measures under:

  • Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)

SmartB may at any time, and from time to time, including multiple times throughout the life of an account:

  • Require identity verification
  • Re-request identity verification
  • Request updated identification documents
  • Conduct enhanced due diligence
  • Monitor transactions
  • Conduct ongoing account and behavioural reviews
  • Require source of funds and source of wealth information
  • Require any additional documentation or information SmartB considers necessary for compliance, risk management, fraud prevention, or operational integrity

SmartB may:

  • Freeze accounts indefinitely
  • Block transactions
  • Delay or refuse withdrawals
  • Suspend or close accounts
  • Report users to AUSTRAC, law enforcement agencies, regulators, courts, government bodies, or other competent authorities
  • Disclose, provide, or share user data, account information, transaction records, identity documents, and related information where required by law, regulation, lawful request, or where SmartB reasonably considers such disclosure necessary for investigation, compliance, fraud prevention, or enforcement purposes

Users must not:

  • Use the Platform for money laundering
  • Use third-party funds
  • Attempt to disguise transaction origins
  • Provide false, misleading, incomplete, or outdated information
  • Attempt to avoid, circumvent, or frustrate KYC, AML, fraud, or verification processes

Failure to comply with any KYC, AML, source of funds, or verification requirement may result in:

  • Account suspension
  • Account restriction
  • Permanent account closure
  • Withholding or forfeiture of balances
  • Reversal of winnings where permitted by law or reasonably required for compliance or fraud prevention

7. Source of Funds & Financial Integrity

Users warrant that:

  • All funds are legally obtained
  • Funds are not linked to criminal activity

SmartB may request proof of source of funds.

Failure to comply may result in:

  • Permanent account closure
  • Forfeiture of all balances

8. SmartCoins – Legal Position

SmartCoins:

  • Are a revocable licence, not property
  • Have no cash value unless explicitly allowed
  • Are subject to modification or removal at any time

SmartB may:

  • Adjust balances without notice
  • Expire or void coins

9. Bonus Abuse, Arbitrage & Advantage Play

Prohibited behaviour includes:

  • Multi-accounting
  • Coordinated play
  • Exploiting pricing or system inefficiencies

SmartB may:

  • Void all activity
  • Reverse winnings (including historical)
  • Confiscate balances

10. Cheating, Collusion & Exploitation

Users must not:

  • Use bots, scripts, or automation
  • Share lineups or coordinate outcomes
  • Exploit bugs or loopholes

SmartB may take action including:

  • Retroactive disqualification
  • Lifetime bans
  • Withholding all funds

11. System Errors – Absolute Operator Rights

In the event of any error (technical, human, or system):

SmartB reserves the unrestricted right to:

  • Void any transaction or contest
  • Reverse winnings at any time (including after withdrawal)
  • Recalculate outcomes

Users waive any claim arising from such corrections.

12. Risk Management & Settlement Controls

SmartB may apply internal risk controls including:

  • Manual reviews
  • Delayed settlements (no time limit)
  • Withholding of payouts

These controls are final and non-negotiable.

13. Withdrawals – Full Control Clause

SmartB may:

  • Delay withdrawals indefinitely
  • Set minimum and maximum withdrawal limits
  • Require additional verification at any time

Withdrawals may be refused where:

  • Fraud is suspected
  • KYC is incomplete
  • Terms are breached

SmartB is not liable for delays.

14. Forfeiture of Funds

SmartB may confiscate funds where:

  • Fraud is suspected
  • Terms are breached
  • Regulatory obligations require action

No compensation is payable.

15. Fraud Detection & Enforcement

SmartB uses monitoring systems to detect:

  • Irregular play patterns
  • Collusion
  • Financial anomalies

SmartB decisions are final and not subject to dispute.

16. Suspension, Closure & Blacklisting

SmartB may:

  • Suspend accounts without notice
  • Permanently ban users
  • Share information with other platforms or authorities

17. Third-Party Services & Data

SmartB relies on third-party providers.

SmartB is not liable for:

  • Provider failures
  • Data inaccuracies
  • Service interruptions

18. Limitation of Liability (Maximum Scope)

To the fullest extent permitted by law:

SmartB excludes all liability for:

  • Indirect or consequential loss
  • Loss of profits
  • Loss of opportunity

Total liability is capped at:

  • The lesser of $100 AUD or total user deposits in the last 3 months

19. Indemnity (Broad Form)

Users indemnify SmartB against all claims arising from:

  • Use of the Platform
  • Breach of Terms
  • Violation of laws

20. No Warranty

The Platform is provided "as is" and "as available" with no warranties.

21. Force Majeure

SmartB is not liable for events outside its control including:

  • System outages
  • Data failures
  • Regulatory actions

22. Amendments

SmartB may update Terms at any time without notice.

Continued use = acceptance.

23. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.

Users submit to exclusive jurisdiction of NSW courts.

24. Chargebacks & Payment Reversals

Users must not initiate chargebacks or payment disputes without first contacting SmartB.

Where a chargeback occurs, SmartB may:

  • Immediately suspend the account
  • Recover the disputed amount
  • Offset any account balance
  • Permanently ban the user

Users remain liable for all amounts owed.

25. Dormant Accounts & Balance Expiry

Accounts inactive for 12 months may be classified as dormant.

SmartB may:

  • Suspend dormant accounts
  • Expire SmartCoins or balances
  • Apply administrative fees where permitted by law

Users are responsible for maintaining account activity.

26. Geo-Restrictions, VPN & Location Controls

Users must not:

  • Access the Platform from restricted jurisdictions
  • Use VPNs, proxies, or masking tools to bypass restrictions

SmartB may:

  • Block access
  • Suspend accounts
  • Void winnings

27. Tax Responsibility

Users are solely responsible for:

  • Declaring winnings
  • Paying applicable taxes

SmartB provides no tax advice and accepts no liability for tax obligations.

28. Dispute Resolution (Operator-Favouring)

All disputes must be submitted to SmartB support.

Users agree that:

  • SmartB decisions are final and binding
  • No class actions may be brought
  • Disputes must be resolved individually

SmartB may elect the method of dispute resolution.

29. Game Mechanics & Platform Changes

SmartB may at any time:

  • Modify contest formats
  • Change scoring systems
  • Alter prize structures
  • Suspend or remove features

No compensation is payable for such changes.

30. Affiliate Abuse & Syndicate Detection

Users must not:

  • Engage in coordinated group play
  • Exploit affiliate programs
  • Use syndicates to manipulate outcomes

SmartB may:

  • Void all related activity
  • Confiscate funds
  • Terminate all linked accounts

31. Extended Operator Rights Clause

SmartB retains absolute discretion over all aspects of the Platform, including:

  • Account management
  • Fund handling
  • Contest outcomes

All decisions made by SmartB are final, binding, and not subject to appeal.
